Legal
Terms &
Conditions
1. Operator Identity
These Terms and Conditions (“Terms”) govern your use of the PUND123.BET website located at https://pund123.bet (“Platform”), operated by:
- Legal entity: PUNT 123 PTY LTD
- ABN: 79 652 754 464
- ACN: 652 754 464
- Principal place of business: 72 Brady Road, BENTLEIGH EAST VIC 3165
- Regulator: Victorian Gambling and Casino Control Commission (VGCCC)
2. Acceptance of Terms
By creating an account, depositing funds, or placing a bet on the Platform, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy, Cookie Policy and Responsible Gambling Policy.
We reserve the right to update these Terms. Material changes will be notified by email. Continued use after the effective date constitutes acceptance.
3. Eligibility
To use the Platform you must:
- Be at least 18 years of age, verified through identity-document checks (KYC) — not by self-declaration alone.
- Be a resident of a jurisdiction where online wagering is lawful.
- Not be self-excluded from online wagering under the BetStop National Self-Exclusion Register or any other applicable scheme.
- Not be an employee, director or contractor of PUNT 123 PTY LTD, or an immediate family member of one.
4. Your Responsibilities
When you use the Platform, you agree that you are responsible for:
- Keeping your login details and any two-factor authentication secure, and for all activity on your account.
- Providing true, current and complete information, and keeping your contact and address details up to date.
- Every bet you place and confirm. Once accepted, a bet stands subject to these Terms and the applicable betting and settlement rules.
- Ensuring online wagering is lawful where you are located, and meeting any personal obligations (including tax) arising from your use of the Platform.
- Notifying us promptly of any error, unauthorised access, or bet recorded incorrectly.
5. Account Registration & KYC
You may hold only one account. Duplicate accounts will be closed and balances may be forfeited.
We are required by law to verify your identity (KYC) under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and Rules. You must provide accurate personal information and a residential address (not a PO Box). We may request government-issued photo ID, proof of address and source-of-funds documentation. Betting and withdrawals may be restricted, and funds withheld, pending verification. See our AML/CTF & KYC page.
6. Deposits & Withdrawals
Deposits are accepted via approved payment methods — debit cards (Visa / Mastercard), PayID and bank transfer. Minimum deposit: AUD $10. We do not accept credit cards (in line with Australian law) or cash deposits.
Withdrawal requests are processed within 3–5 business days to a verified payment method held in your own name. Withdrawals to third-party accounts are not permitted. Withdrawals are returned to the method used to deposit; where that method cannot receive a withdrawal, funds are paid to an alternative verified method in your name. Withdrawal limits and processing times are set out in your Account section.
Fees: We do not charge a fee for deposits or for standard withdrawals. Any third-party charges applied by your bank or payment provider are your responsibility. If any account or transaction fee is ever introduced, it will be disclosed to you before it applies.
We may withhold withdrawals pending identity verification or where we have reasonable suspicion of fraud or money laundering.
Deposit limits you set apply across all deposit channels combined. See Deposit Limits.
7. Protection of Customer Funds
Customer account balances are held separately from our day-to-day operating funds, in accordance with our licence conditions and applicable Australian requirements, so that withdrawable balances are not used to finance our operations. Holding funds in your account does not earn interest.
8. Betting Rules
Bets are accepted and settled according to the rules applicable to each sport or event, as published on the Platform, together with the Settlement Rules below. We reserve the right to void bets placed in error (“palpable error”), including where odds are clearly incorrect.
All wagering is on a fixed-odds, pre-match basis. In the event of a technical malfunction, affected bets are void and stakes returned.
9. Settlement Rules
These Settlement Rules apply to all markets unless a specific market rule published on the Platform states otherwise. They are referred to by our Sports and Racing pages.
- Official result: markets settle on the result officially declared by the relevant governing body. Subsequent disqualifications, protests or appeals after the official result do not change settlement, unless the market rules say otherwise.
- Abandoned, postponed or suspended events: if an event is not completed within the period set out in the relevant sport's rules, affected markets are void and stakes returned, unless the outcome is already determined.
- Dead heats: where selections tie, the stake is divided by the number of selections in the dead heat and settled at full odds on the divided stake.
- Palpable (obvious) error: bets struck at clearly incorrect prices may be void and stakes returned.
- AFL / NRL / rugby: settle on the full-time score, excluding extra time, unless a market states otherwise.
- Cricket: shortened matches follow the official method (e.g. DLS); a match with no official result is void.
- Tennis: if a player retires or is disqualified, market-specific rules apply — some markets stand once a set or match is completed, others are void.
- Racing: fixed-odds win and place bets on a scratched runner are refunded; place terms depend on the number of runners; exotics are settled under the relevant racing authority's rules.
If you believe a bet has been settled incorrectly, contact us — see Complaints below.
10. Limits on Stakes & Maximum Payouts
All bets are accepted at our discretion and subject to limits. We may set minimum and maximum stakes for any market, customer or account, and may apply maximum payout limits per bet, per market, per event or per day. Where a payout would exceed an applicable maximum, winnings are capped at that maximum.
We may decline, limit or partially accept a stake, and may adjust limits at any time, including for risk-management, integrity or responsible-gambling reasons.
11. Promotions & Inducements
All promotions are subject to individual terms and conditions. In the event of conflict, the specific promotion terms take precedence over these Terms. See our Promotional Terms.
We do not offer inducements to open an account, to refer another person, or to bet, where prohibited by Victorian or Australian law. Inducements and promotions are not offered to customers in New South Wales. Customers who have activated self-exclusion are excluded from all promotions and promotional messaging for the duration of the exclusion.
12. Race-Fields & Wagering Integrity
PUNT 123 PTY LTD uses race-fields information published by, and operates under race-fields (publication and use) approvals or agreements with, the relevant Australian principal racing authorities, in accordance with the applicable race-fields legislation in each State and Territory, and pays the applicable race-fields fees.
We cooperate with Sport Integrity Australia, sports controlling bodies and racing authorities on wagering integrity, and may share betting information and report suspicious activity to support the integrity framework. See our Sports Integrity page.
13. Prohibited Conduct
The following are prohibited:
- Match fixing, spot fixing or any form of corrupt activity.
- Use of automated bots or systems to place bets.
- Collusion, bonus abuse or advantage play.
- Use of the Platform for money laundering or any unlawful purpose.
We will report suspected illegal activity to the relevant authorities.
14. Use of Customer Data
We collect, use and disclose your personal information only as described in our Privacy Policy and Cookie Policy, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using the Platform you acknowledge those policies, which form part of these Terms. They explain what we collect, why, who we share it with (including AUSTRAC, regulators, racing and sports integrity bodies) and how to access or correct it.
15. Taxes
You are responsible for any personal tax that may apply to your winnings under the law of your place of residence. Any government taxes, levies or duties payable by us in connection with wagering are accounted for by us and are not separately charged to your account, except where the law requires otherwise.
16. Dormant Accounts
An account is considered dormant after 12 months of inactivity. We will notify you before any action is taken. Funds in dormant accounts are held securely. After 36 months, unclaimed balances may be dealt with in accordance with applicable unclaimed money legislation. See Account Closure.
17. Account Closure & Termination
You may close your account at any time from your Account settings or by contacting us; any withdrawable balance is returned to a verified payment method in your name. See our Account Closure page.
We may suspend, restrict or close an account where you breach these Terms, where required for fraud, AML/CTF, integrity or regulatory reasons, or where we have responsible-gambling concerns. Where an account is closed for a serious breach, balances obtained through that breach may be withheld pending investigation.
18. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, to the maximum extent permitted by law our liability to you is limited to the amount of funds held in your account at the time of the relevant event.
We are not liable for losses arising from internet connectivity issues, device failure, or circumstances beyond our reasonable control.
19. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Victoria.
20. Complaints
If you have a complaint, the first step is to contact us directly at support@pund123.bet. We will acknowledge within 2 business days and aim to provide a full response within 10 business days.
Our full complaints procedure and timeframes are set out on our Complaints & Dispute Resolution page.
21. Dispute Resolution
If your complaint is not resolved to your satisfaction through our internal process, you may escalate it to an independent body — including the Victorian Gambling and Casino Control Commission (VGCCC) for wagering matters, the Office of the Australian Information Commissioner (OAIC) for privacy matters, or the Australian Financial Complaints Authority (AFCA) for eligible financial-services matters. Contact details are on our Complaints & Dispute Resolution page.
Using this process does not limit any rights or remedies you have under the Australian Consumer Law or other applicable law.
This document is a structural draft only. It does not constitute legal advice. PUNT 123 PTY LTD must have this document reviewed and approved by a qualified lawyer admitted in Victoria, Australia before publication.
